1. Use of Service
By accessing or using HometownLive (the “Service”), you agree to be bound by these Terms of Service. If you are accepting these terms on behalf of an organization, you represent that you have the authority to do so.
HometownLive grants you a limited, non-exclusive, non-transferable license to access and use the Service for your organization's lawful streaming purposes. You may not sublicense, resell, or otherwise transfer your right to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
2. Streaming Content
You are solely responsible for all content you stream or upload through the Service. By streaming content, you represent and warrant that:
- You have all necessary rights, licenses, and permissions to stream the content
- The content does not infringe on any third-party intellectual property rights
- The content complies with all applicable laws, including copyright and student privacy laws (FERPA, COPPA)
- The content does not contain material that is defamatory, obscene, or otherwise inappropriate for a community audience
HometownLive reserves the right to remove content that violates these terms or applicable law, and to suspend or terminate accounts for repeated violations.
3. Payment Terms
Subscription fees are billed annually in advance. All fees are non-refundable except as required by applicable law or as expressly provided in your written agreement with HometownLive.
If your payment fails, HometownLive may suspend access to the Service until payment is received. You are responsible for keeping your billing information up to date.
HometownLive may update pricing with 30 days written notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
4. Service Availability
HometownLive strives to maintain high availability but does not guarantee uninterrupted service. We will make commercially reasonable efforts to notify customers of planned maintenance in advance.
HometownLive is not responsible for service interruptions caused by factors outside our control, including internet outages, third-party service provider failures, or force majeure events.
5. Limitation of Liability
To the maximum extent permitted by applicable law, HometownLive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if HometownLive has been advised of the possibility of such damages.
HometownLive's total aggregate liability to you for any claims arising out of or related to the Service shall not exceed the fees paid by you in the twelve months preceding the claim.
6. Termination
Either party may terminate this agreement by providing 30 days written notice. HometownLive may terminate immediately for material breach, including non-payment or violation of content policies.
Upon termination, your access to the Service will cease and HometownLive will retain your data for 30 days, during which you may request an export. After that period, data may be deleted.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction in Texas.
